Terms of Service

These Terms of Service ("Terms") constitute a binding legal agreement between you ("you," "your," or "User") and the operator of CustomSkill, accessible at customskill.app (the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

Please read these Terms carefully. They contain important provisions regarding arbitration, limitation of liability, disclaimer of warranties, and your obligations.

1. Description of the Service

The Service offers a structured, AI-assisted interview designed to produce a personalized Markdown skill file based on your responses. The output is intended to help configure third-party AI assistants to reflect your professional preferences, workflows, and standards. The Service may include paywall experiments, pricing tests, email delivery, and a web-based hub to manage purchased skills.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, to the extent permitted by law.

2. Eligibility and account

  • You must be at least 18 years old (or the age of legal majority where you reside) and capable of forming a binding contract.
  • You may not use the Service if you are barred under applicable law or if you have been previously suspended.
  • The Service does not require a traditional username/password account. Access during an interview may be tied to browser session cookies; post-purchase management may use time-limited signed links sent to your email.
  • You are responsible for maintaining control of your email inbox and any devices used to access the Service.

3. Purchases, pricing, and payment

Certain features require a one-time purchase per skill file (per selected professional role or category). Displayed prices may vary based on product experiments conducted in our legitimate business interest. The price shown to you at checkout is the price charged for that transaction.

  • Payments are processed by a third-party payment processor. You authorize us and our processor to charge your selected payment method for the disclosed amount.
  • All fees are stated in U.S. dollars unless otherwise indicated at checkout.
  • Taxes may apply where required by law and will be presented at checkout when applicable.
  • You represent that payment information you provide is accurate and that you are authorized to use the payment method.

Failure to complete payment may prevent delivery of the full skill file. We are not responsible for delays caused by payment networks, banks, or incorrect contact information.

4. Refund policy

We offer a 14-day satisfaction guarantee from the date of purchase: if the delivered skill file is not useful to you, you may contact support within fourteen (14) calendar days to request a refund. Refund eligibility requires good-faith engagement with the Service and may be denied in cases of abuse, fraud, repeated refund requests, or violation of these Terms.

Refunds are issued to the original payment method where technically possible. Nothing in this section limits mandatory consumer rights that cannot be waived under applicable law.

5. Your content and license to us

You retain ownership of interview answers and other content you submit ("User Content"). As between you and us, ownership of the generated skill file is assigned to you upon delivery, subject to these Terms.

You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, and display User Content solely to operate the Service, including AI synthesis, email delivery, storage, backup, support, and legal compliance. This license ends when User Content is deleted from our active systems, except for copies retained in backups or as required by law.

You represent and warrant that you have all rights necessary to submit User Content and that it does not infringe third-party rights or violate law.

6. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, fraudulent, or deceptive purposes.
  • Submit content that is defamatory, harassing, hateful, obscene, or that violates privacy or intellectual property rights.
  • Attempt to gain unauthorized access to systems, accounts, or data.
  • Interfere with the Service through scraping, automated abuse, denial-of-service activity, or circumvention of security or rate limits.
  • Resell, sublicense, or commercially exploit the Service except as expressly permitted.
  • Misrepresent your identity or affiliation.
  • Use the Service to provide regulated professional advice (legal, medical, financial, or similar) without appropriate licensure and independent verification.

We may suspend or terminate access for violations, with or without notice, to the extent permitted by law.

7. Artificial intelligence and output disclaimer

The Service uses automated and AI-assisted systems. Outputs may be incomplete, inaccurate, outdated, or inappropriate for your circumstances. THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED FOR GENERAL PRODUCTIVITY PURPOSES ONLY.

  • We do not guarantee that interview questions, synthesized files, or suggestions will be error-free or suitable for any particular use.
  • You are solely responsible for reviewing, editing, and validating any skill file before use.
  • The Service does not provide legal, medical, financial, tax, employment, or other professional advice.
  • Use of third-party AI platforms after export is at your own risk and subject to those platforms' terms.

8. Our intellectual property

The Service, including its software, design, branding, templates, question flows, and documentation (excluding User Content and your delivered skill file), is owned by us or our licensors and protected by intellectual property laws. No rights are granted except as expressly stated. You may not copy, modify, or create derivative works of the Service itself without prior written consent.

9. Third-party services

The Service integrates with third-party providers for hosting, payments, email, analytics, experimentation, and AI inference. Your use of those components may be subject to additional terms imposed by such providers. We are not liable for third-party acts or omissions beyond our reasonable control.

10. Privacy

Our collection and use of personal information is described in the Privacy Policy at https://customskill.app/privacy. By using the Service, you consent to such processing as described therein.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR HARMFUL COMPONENTS, OR THAT RESULTS OBTAINED FROM USE WILL MEET YOUR REQUIREMENTS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SKILL FILE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless the Service operator, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or applicable law; or (d) your use of generated content with third-party AI systems.

14. Release

To the extent permitted by law, you release us from claims, demands, and damages of every kind arising out of disputes with third parties in connection with your use of the Service or exported skill files. If you are a California resident, you waive California Civil Code Section 1542 to the extent permitted by law (and similar provisions elsewhere).

15. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence require otherwise.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in such courts, unless applicable law requires a different forum for consumers.

You and we agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, to the extent permitted by law.

16. Termination

You may stop using the Service at any time. We may terminate or suspend your access immediately for breach of these Terms, suspected fraud, or legal compliance. Upon termination, provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

17. Force majeure

We are not liable for failure or delay in performance due to events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, power outages, governmental actions, or failures of third-party hosting or AI providers.

18. Export compliance

You may not use the Service in violation of U.S. export control or sanctions laws. You represent that you are not located in, or a national of, any country or person subject to comprehensive embargoes where use would be prohibited.

19. General provisions

  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
  • Severability: If any provision is held invalid, the remainder remains in effect.
  • Waiver: Failure to enforce a provision is not a waiver of future enforcement.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a business transfer.
  • No agency: No joint venture, partnership, employment, or agency relationship is created.
  • Headings: Section headings are for convenience only.

20. Changes to these Terms

We may revise these Terms at any time by posting an updated version with a new "Last updated" date. Material changes will be communicated where required by law. Continued use after the effective date constitutes acceptance of revised Terms where permitted.
